Terms of Service
These terms describe, in plain words, the rules for using BeatFollow - an online tool for music producers to manage sending beats to artists and A&R contacts. They are the terms of service required by the Polish Act on Providing Services by Electronic Means, and they respect your rights under the Polish Consumer Rights Act. The service is provided by Tomasz Migdoł, contact: tomaszmig7@gmail.com.
01Definitions
- Provider - Tomasz Migdoł, the person who provides the Service and operates the beatfollow.com website, contact email: tomaszmig7@gmail.com.
- User - anyone who creates an Account and uses the Service, whether as a consumer or in connection with their business.
- Service - BeatFollow, an online application that lets you keep track of your beats, contacts and placements (beat submissions), together with all related features available at beatfollow.com.
- Account - your personal, password-protected space in the Service, holding the data you enter and your plan information.
- Free plan and Paid plan - the two ways of using the Service, described in section 04.
- Terms - this document.
02Conditions of use
You may create an Account if you are at least 16 years old and have the legal capacity to enter into an agreement. If you use the Service on behalf of a company, you confirm you are authorised to accept these Terms for it.
To use the Service you need:
- a device with internet access,
- a current version of a modern web browser (Chrome, Safari, Edge or Firefox) with JavaScript and cookies enabled,
- a working email address.
You agree not to use the Service to send unlawful content, to break into other users' accounts, to overload or disrupt the Service, to scrape it automatically, or to store personal data of third parties in a way that breaks data protection law. You are responsible for the content you enter into your Account.
03Registration and account
You create an Account by entering your email address and a password, or by signing in with Google. During sign-up you confirm that you have read and accept these Terms and the Privacy Policy. Acceptance is required to create an Account.
After sign-up we send a confirmation link to your email address. Clicking it activates the Account and concludes the agreement for electronic services between you and the Provider for an indefinite period. The agreement is free of charge until you choose the Paid plan.
Keep your password confidential and do not share your Account with others. Please tell us at tomaszmig7@gmail.com if you suspect someone else has access to your Account. The data you enter must be true and, in the case of your email address, current.
04Plans and settlement
The Service is available in two plans:
- Free plan - free of charge, with a limit of one record in each list: one beat, one contact and one placement. It is meant for trying the Service out. You can keep using it for as long as you like.
- Paid plan - USD 9.99 per month, with full access: an unlimited number of beats, contacts and placements, plus every feature of the Service available at the time.
The price is shown in US dollars and includes any taxes charged by the payment provider where applicable. The Provider may change prices for the future; a price change never applies to a billing period you have already paid for, and we will let you know by email at least 14 days before it takes effect. If you do not accept a new price, you can cancel the subscription before it applies.
If your Paid plan ends, your data is not deleted - the Account returns to the Free plan and records above the free limit become read-only until you subscribe again.
05Payments and billing cycle
Payments are handled by Stripe Payments Europe, Ltd. Card details are entered on Stripe's secure page and are never stored on the Provider's servers. To pay you need a payment card or another method supported by Stripe.
The subscription is monthly and renews automatically. Your card is charged USD 9.99 on the day you subscribe and then on the same day of each following month, until you cancel. Stripe issues a receipt or invoice for each payment and sends it to your email address.
If a payment fails, Stripe retries it for a few days. If it still fails, the Paid plan ends and your Account returns to the Free plan. You can update your card at any time in the customer portal available in the Service.
06Right of withdrawal (14 days)
If you are a consumer (or a sole trader for whom the purchase is not of a professional nature), you may withdraw from the agreement for the Paid plan within 14 days of concluding it, without giving a reason and without extra cost.
To withdraw, send a clear statement to tomaszmig7@gmail.com - for example: "I withdraw from the agreement for the BeatFollow paid plan concluded on [date]." Sending the statement before the 14 days are over is enough to meet the deadline. We refund the payment using the same payment method within 14 days of receiving your statement.
Important: because the Paid plan starts immediately, when you subscribe you expressly request that the Provider begins providing the service before the withdrawal period ends, and you acknowledge that you lose the right of withdrawal once the service has been fully performed. If you withdraw after the service has begun but before it is fully performed, you pay an amount proportional to the part of the service already delivered.
The Free plan is free of charge, so no payment is involved and nothing needs to be refunded.
07Cancelling a subscription
You can cancel the subscription at any time, without giving a reason, in the customer portal inside the Service (the billing section) or by emailing tomaszmig7@gmail.com.
Cancelling stops future renewals. You keep full access until the end of the period you have already paid for; after that the Account switches to the Free plan. We do not charge cancellation fees, and we do not refund the unused part of the current period unless mandatory law requires it (for example a valid withdrawal under section 06 or a justified complaint).
You can also delete the whole Account by writing to tomaszmig7@gmail.com. This ends the agreement and removes your data, subject to the retention periods described in the Privacy Policy.
08Liability of the Provider
The Provider undertakes to provide the Service with due care and to keep it available as continuously as reasonably possible. We may carry out maintenance that briefly limits access; where it is planned, we announce it in advance.
The Provider is not liable for:
- interruptions caused by events outside our control (internet failures, actions of hosting, payment or email providers, force majeure),
- the content you enter and how you use it, including whether you have a legal basis to store contact details of third parties,
- business results - the Service helps you organise your work but does not guarantee placements, replies or income,
- losing access because you shared your password or lost control of your email account.
Nothing in these Terms limits the Provider's liability towards consumers where Polish law does not allow such a limitation, in particular for intentional fault or damage to health or life. For Users who are not consumers, the Provider's liability is limited to the fees paid for the 12 months preceding the event and excludes lost profits.
We recommend keeping your own copy of important data; you can request an export at any time by writing to tomaszmig7@gmail.com.
09Complaints
If the Service does not work as it should, please file a complaint by email to tomaszmig7@gmail.com. Describe the problem, when it happened and the email address of your Account - that is enough for us to look into it.
We reply within 14 days of receiving the complaint, to the email address you wrote from. If we do not reply within that time, the complaint is deemed accepted.
Consumers may also use out-of-court dispute resolution, including the EU ODR platform at ec.europa.eu/consumers/odr and the assistance of a municipal or district consumer ombudsman. Using these routes is voluntary.
10Suspending and deleting accounts
The Provider may suspend or delete an Account if the User seriously or repeatedly breaks these Terms - for example by using the Service unlawfully, attacking or overloading it, entering content that infringes other people's rights, or trying to bypass plan limits or payments.
Before suspending an Account we send a warning to your email address and, where the breach can be fixed, give you at least 7 days to do so - unless the breach is grave (unlawful action, an attack on the Service) and requires immediate blocking. You may appeal by writing to tomaszmig7@gmail.com; we handle appeals like complaints, within 14 days. If the appeal succeeds we restore the Account immediately.
If an Account is deleted for a breach, any unused part of a paid period is refunded only where the User was not at fault.
11Final provisions
The Provider may amend these Terms for important reasons: changes in the law, new or discontinued features, changes to prices or payment providers, or security requirements. We notify registered Users of changes by email or with a notice in the Service at least 14 days before they take effect.
If you do not accept the new Terms, you can cancel your subscription or delete your Account before the change takes effect; continuing to use the Service after that date means you accept the new version. Changes never affect rights you have already acquired or a billing period already paid for.
These Terms are governed by Polish law. Choosing Polish law does not deprive a consumer of protection under the mandatory rules of the country where they habitually live.
Disputes with consumers are settled by the court having jurisdiction under general rules. Disputes with Users who are not consumers are settled by the court having jurisdiction over the Provider's place of residence.
Matters not covered here are governed by the Polish Civil Code, the Act on Providing Services by Electronic Means and the Consumer Rights Act. Personal data is handled as described in the Privacy Policy.
12Effective date
These Terms take effect on September 18, 2026 and apply to agreements concluded from that date.
